Welcome to Surfside Sweets! These Terms & Conditions outline the terms that apply when you use our website, purchase our products, or book a Surfside Sweets event or candy cart experience.
By submitting an inquiry, placing an order, booking an event, or using our website, you agree to these Terms & Conditions.
1. About Surfside Sweets
Surfside Sweets is a Santa Monica, California-based candy company offering curated candy products and mobile candy cart experiences for events, celebrations, and gatherings.
Our services may include candy carts, candy displays, favors, custom candy assortments, and other event-related offerings. Specific services, pricing, and inclusions will be outlined in your event proposal or booking confirmation.
2. Event Inquiries & Bookings
Submitting an inquiry through our website does not guarantee availability or reserve your event date.
An event is considered officially booked only after:
We have confirmed availability and agreed to the event details;
You have accepted the applicable proposal or booking terms; and
Any required deposit or payment has been received.
Event pricing and availability may vary depending on the date, location, guest count, event duration, services requested, and other event-specific details.
We reserve the right to decline an event or request at our discretion.
3. Pricing & Payment
Pricing will be provided based on the specific services and details of your event.
Unless otherwise agreed in writing, a deposit may be required to secure your event date, with the remaining balance due according to the payment schedule provided in your proposal or booking confirmation.
All prices are in U.S. dollars and are subject to applicable taxes, delivery fees, travel fees, rentals, or other charges disclosed at the time of booking.
Additional services or changes requested after booking may result in additional charges.
4. Cancellations & Rescheduling
Because event dates are reserved specifically for you, cancellations may result in the loss of some or all of your deposit.
Our cancellation and refund terms will be included in your event proposal or booking confirmation and may vary depending on the size and nature of the event.
If you need to reschedule, please contact us as soon as possible. We will make reasonable efforts to accommodate a new date, subject to availability. Rescheduling is not guaranteed, and additional fees may apply.
If Surfside Sweets must cancel an event due to circumstances within our control, we will work with you to provide an appropriate refund or alternative arrangement.
5. Event Changes
We understand that event details can change. Please notify us as soon as possible if there are changes to:
Event date or time
Event location
Guest count
Venue access
Setup requirements
Event duration
Candy or service selections
Some changes may affect pricing or our ability to provide the originally agreed-upon services.
Final event details may need to be confirmed by a specified deadline communicated by Surfside Sweets.
6. Venue & Setup Requirements
The client is responsible for ensuring that Surfside Sweets and its team have reasonable access to the event location for setup, service, and breakdown.
Unless otherwise agreed, the client is responsible for providing a suitable event space and ensuring that any required venue permissions have been obtained.
Outdoor events may require additional considerations related to weather, shade, wind, uneven surfaces, or other environmental conditions.
If conditions make it unsafe or impractical to operate the candy cart or display as planned, Surfside Sweets may modify, relocate, pause, or cancel the service. We will work with the client to find a reasonable alternative whenever possible.
7. Weather
For outdoor events, the client is responsible for providing an appropriate covered or weather-protected area when necessary.
Surfside Sweets may modify the setup or service due to rain, excessive heat, high winds, or other weather conditions that could affect food safety, equipment, or the safety of our team and guests.
Weather-related changes do not automatically entitle the client to a refund if Surfside Sweets is otherwise able to provide the agreed-upon services.
8. Candy, Ingredients & Allergens
Surfside Sweets offers a variety of candy products, which may contain or come into contact with common allergens.
Because candy products may be manufactured, packaged, or handled in facilities that process allergens, we cannot guarantee that any product is completely free from allergens or cross-contact.
If you or your guests have a food allergy or dietary restriction, please let us know before booking. We will do our best to provide available ingredient information and accommodate reasonable requests, but guests with severe allergies should use their own judgment when consuming our products.
Candy should be consumed according to individual dietary needs and age appropriateness.
9. Product Availability & Substitutions
Candy selections are subject to availability. If a specific candy, color, flavor, or product becomes unavailable, Surfside Sweets may substitute it with a reasonably similar option.
For custom orders, we will make reasonable efforts to match agreed-upon colors, themes, quantities, and selections. Because candy products and colors can vary by manufacturer and batch, exact matches cannot always be guaranteed.
10. Customization
Custom event designs, candy selections, signage, packaging, and other creative elements may vary slightly from digital images, inspiration photos, or mockups.
We reserve the right to make reasonable substitutions or adjustments while maintaining the overall agreed-upon look, feel, and purpose of the service.
Any custom work created specifically for your event may not be refundable once production has begun.
11. Client Responsibilities
The client is responsible for providing accurate event information and promptly communicating any changes that may affect our ability to provide services.
The client is also responsible for the conduct of their guests and for any damage caused by the client or guests to Surfside Sweets' equipment, cart, displays, or other property.
Additional charges may apply for damage, excessive cleanup, or services required as a result of client or guest actions.
12. Photography & Marketing
Surfside Sweets may photograph or record our candy cart, products, displays, and event setups for use on our website, social media, portfolio, and other marketing materials.
We will make reasonable efforts to avoid intentionally identifying private individuals without permission. If you have specific photography or privacy requirements for your event, please let us know in advance.
13. Intellectual Property
All content on the Surfside Sweets website, including logos, branding, photographs, graphics, written content, designs, and other materials, is owned by or licensed to Surfside Sweets and may not be copied, reproduced, modified, or used without our prior written permission.
Custom designs or creative concepts developed by Surfside Sweets remain our intellectual property unless otherwise agreed in writing.
14. Website Use
You agree to use the Surfside Sweets website only for lawful purposes.
You may not use the website to:
Violate any applicable law or regulation;
Interfere with the operation or security of the website;
Attempt to gain unauthorized access to our systems;
Copy or reproduce website content without permission; or
Submit false, misleading, or fraudulent information.
We make reasonable efforts to keep website information accurate and current, but we do not guarantee that all website content will always be complete, accurate, or error-free.

16. Limitation of Liability
To the fullest extent permitted by applicable law, Surfside Sweets will not be responsible for indirect, incidental, special, or consequential damages arising from or related to your use of our website, products, or services.
Our liability relating to an event or purchase will generally be limited to the amount paid to Surfside Sweets for the specific service or product giving rise to the claim, except where a different limitation is prohibited by law.
Nothing in these Terms & Conditions is intended to limit liability that cannot legally be limited or excluded under applicable law.
17. Indemnification
To the extent permitted by law, you agree to be responsible for claims, damages, losses, or expenses arising from your breach of these Terms & Conditions or from your actions or the actions of your guests in connection with an event.
18. Force Majeure
Surfside Sweets will not be considered in breach of these Terms & Conditions if we are unable to perform our obligations due to circumstances beyond our reasonable control, including severe weather, natural disasters, emergencies, government restrictions, venue closures, transportation disruptions, illness, or other unforeseen events.
If a force majeure event affects your booking, we will work with you in good faith to determine an appropriate alternative, which may include rescheduling or refunding applicable amounts depending on the circumstances.
19. Privacy
Your use of our website is also subject to our Privacy Policy, which explains how we collect, use, and protect personal information.
20. Governing Law
These Terms & Conditions are governed by the laws of the State of California, without regard to its conflict-of-law principles.
Any disputes arising from these Terms & Conditions or your relationship with Surfside Sweets will be handled in accordance with applicable California law.

We may update these Terms & Conditions from time to time. When we do, we will update the "Last updated" date at the top of this page.
Your continued use of our website or services after updated Terms & Conditions are posted constitutes acceptance of the updated terms, to the extent permitted by law.
